1. Acceptance of Terms
By accessing or using Fill The Hour, operated by Natter LLC (“Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
Fill The Hour is a cancellation recovery platform designed for healthcare professionals, therapists, and practitioners. The Service helps you fill cancelled appointment slots by notifying waitlisted clients via SMS.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with applicable regulations, including but not limited to healthcare privacy laws (HIPAA, where applicable). You shall not:
- Send unsolicited or spam messages through the platform
- Use the Service for purposes other than legitimate appointment management
- Attempt to gain unauthorized access to any part of the Service
- Upload malicious content or attempt to compromise system security
5. Client Data & Privacy
You must maintain accurate client information and comply with all applicable data protection and healthcare privacy regulations in your jurisdiction.
6. SMS Consent & Compliance
SMS consent is optional and is not a condition of creating an account or using the Service.
By using the SMS features of the Service, you acknowledge and agree to the following:
- Prior consent required: SMS recipients must opt in through our public waitlist signup flow before receiving SMS messages through the platform
- TCPA compliance: You agree to comply with the Telephone Consumer Protection Act (TCPA) and all applicable federal, state, and local laws governing SMS communications
- Opt-out handling: All SMS messages sent through the platform include opt-out instructions (“Reply STOP to opt out”). When a recipient opts out, the platform automatically prevents further messages to that number. You must not attempt to circumvent opt-out requests
- Public disclosure: The public opt-in workflow is documented at /waitlist-signup and /sms-consent
- Message content: Messages sent through the platform must be related to appointment scheduling and must not contain marketing, promotional, or unrelated content
- Prohibited uses: You may not use the SMS feature to send bulk unsolicited messages, messages to numbers without consent, or messages that violate any applicable law
Violation of these SMS terms may result in immediate suspension of your account.
7. Subscription & Billing
The Service is offered on a subscription basis. Pricing, billing cycles, and cancellation terms are as described at the time of purchase. We reserve the right to modify pricing with 30 days notice.
8. Calendar Integration
When you connect third-party calendar services (Google Calendar, Outlook), you grant us read-only access to detect cancelled appointments. We do not modify, create, or delete any calendar events.
9. Limitation of Liability
The Service is provided “as is” without warranties of any kind. Fill The Hour shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Service, including but not limited to missed appointments, undelivered messages, or lost revenue.
10. Termination
We may suspend or terminate your access to the Service at any time for violation of these terms. Upon termination, your data will be retained for 30 days before deletion, unless otherwise required by law.
